Terms of Service

1. Acceptance of Terms

By installing and using WithKudos ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

2. Description of Service

WithKudos is a free Slack application that enables team members to give recognition and kudos to each other through emoji reactions and slash commands. The Service is provided at no cost with optional donation support.

3. User Accounts and Responsibilities

You are responsible for:

• Maintaining the security of your Slack workspace
• All activities that occur under your account
• Ensuring appropriate use of the Service by team members
• Compliance with your organization's policies

4. Free Service and Donations

WithKudos is provided completely free of charge. We may accept voluntary donations through Buy Me a Coffee or similar platforms to support development and hosting costs. Donations are voluntary and do not affect service access or features.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Attempt to circumvent rate limiting or abuse the service
• Reverse engineer or attempt to extract source code
• Use the Service to send spam or unsolicited messages

6. Intellectual Property

The Service and its original content, features, and functionality are owned by WithKudos and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

9. Limitation of Liability

In no event shall WithKudos be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to defend, indemnify, and hold harmless WithKudos from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees).

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be interpreted and governed by the laws of Spain, without regard to conflict of law provisions. WithKudos is operated as a personal project by an individual resident in Spain who is not registered as a self-employed professional (autónomo).

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the Service or email.
